Terms and Conditions

By registering for and/or participating in "The Great Indian Hunt", you and your teammate(s), friends, those you're participating and/or traveling with, etc. (hereafter 'teammate(s)') hold harmless The Tarzan Way and its employees, partners, sponsors, etc. Meaning, you agree to not sue or make any legal claims against The Tarzan Way, its employees, partners or sponsors for any expenses, damages, injuries, or losses from participating in The Great Indian Hunt. You also acknowledge and agree to follow all of the Hunt Rules.

•  You agree to: Participate at your own risk.

•  You agree to: Be smart. Be safe. Be courteous. 

•  You agree to: Use caution and discretion and obey all local laws at all times.

 

 Definitions

In these conditions:

"The Great Indian Hunt" means the treasure hunt that will take place live in countries all over the world in 6 different slot timings on 28th AND 29th of september,2019. 

"The Participant(s)"  is the person(s) who is paying for The Great Indian Hunt to The Tarzan Way.

"Team mate(s)" is the person(s) which is chosen by the participant to experience the hunt with him. He/She/they are in whatsoever case not eligible for any discounts or prizes by "The Tarzan Way" 

"TTW” or “The Tarzan Way" is the organizer of the event under the name  Tarzan Way Travel Private Limited as registered with the Government of India. 

 

Instructions

 

1.) Date and Scope of Services.

 1.1 “The Tarzan Way ” shall provide the experience in form of "The Great Indian Hunt"  on the date and time as outlined on the invoice e.i 28th/29th of September 2019 with the preferred slot timings chosen by the participant.

1.2  There are only 3 slot timings in 2 Days. No other slot time can be allotted to the participant.

1.3 Available Time Slots along wih Date according to Indian Standard time:

1. 7:30-10:30 am - 28th and 29th of September

2. 3:30- 6:30 pm - 28th and 29th of September

3. 1130- 2:30 pm- 28th and 29th of September

 

 

 

2.) Fees Deposit

2.1 The fees of $30/$50 depending upon the team size shall be paid before the commencement of the event.

2.2 The fee shall be paid in one go and there are no partial payment, EMI or installment options available.

2.3 No Entries and Payments will be allowed after 12AM on 26th of September in accordance with the Indian Standard Time.

2.4 . In the event of your cancellation of the Hunt, the Deposit shall be non-refundable, however it can be applied to different slots ( subject to availability)  and for receiving discounts on our trips with the “The Tarzan Way” within three (3) years of the Hunt Date. ( applicable only on selected excursions or travel experiences)

 

3.) Cancellation

3.1 The Participant can get a complete refund of your ticket price if applied 14 days before the commencement of the hunt.

3.2 Cancellation Policy: There will be no service fee charged by TTW for handling cancellation request however online transaction fee may be charged depending upon the choice of mode of transaction ranging from 2 to 5% depending upon the mode of payment preferred by the participant reimbursed.  

3.3. Reimbursement for the cancellation will be processed within 48 hours of confirmation but date of reimbursement will depend on the mode of payment and TTW cannot be held responsible for any delay because of any issue raised by the payment portal and/or bank..  

 

 4.) Delays or Postponements

4.1 If the starting time of the Hunt in any city is delayed as a result of circumstances beyond our control (i.e. hazardous weather, dangerous road conditions, mechanical problems, etc.) we will use our best efforts to fulfill our Agreement by adjusting the time of the Hunt to a mutually satisfactory one. The Hunt, however, shall take place rain or shine.  Any decision by the participant to cancel the event due to weather (unless cancelled within the timeframe set, which is 14 days before the hunt) shall not be refunded.

4.2  However, In case more than 10 participants from the same region or time slot cancel due to similar reasons outside their control, a separate time slot can be set up for them on a mutually agreeable time.

4.3 TTW will not held liable in any cancellation or postponement of the event due to  circumstances beyond TTW control including but not limited hazardous weather, dangerous road conditions, riots and government standstill  in the host country or in the participant's city.

 

 5.) Hunt Behavior.

5.1 The Participant shall be fully and solely responsible for any damage or loss to any equipment used during the Hunt. 

5.2 “The Tarzan Way” shall not be liable for any damage, loss or injury to any person or property arising out of or resulting from any act or omission of Hunt except such as may result from Hunt’s gross negligence or willful misconduct.

5.3  We reserve the right to remove you from the Hunt if, in Hunt’s sole judgment, you pose a threat to the safety of others or is likely to damage other’s personal or real property.  In the unlikely event, The Participant shall be removed from the Hunt and not be entitled to a refund.

5.4 Consumption of any illegal substance according to the participant's city laws during the hunt will lead to immediate suspension. 

5.5 TTW in any case will not be held liable if the participant and/or his team mates break any laws governed by the city.

 

6.) Releases 

6.1 The Participant hereby irrevocably, absolutely and in perpetuity, grant unlimited permission to the Releases to film, videotape and record gratis the performance of the above named participant in the Event and subsequently to telecast, sell, distribute and other utilize the same in whatever manner Releasees deem appropriate. Such permission includes without limitation granting the unlimited and irrevocable right to Releasees, without compensation of any kind to me, to own, use, publish, copyright, reproduce, sell, distribute, or broadcast my name, nickname, image, likeness, voice, photograph, signature facsimile, or any other depiction of any kind of me or my likeness (collectively the “Images”), in connection with or due The Participant’s participation in the Event, in any electronic or print format or media or format whatsoever, whether such format is now known or later developed. The Participant  acknowledges and agrees that Releasees and their representatives will have this unlimited right throughout the world.

 

7.) Price

The price charged by TTW for the provision of the Services shall be as stated in the Booking Confirmation Form of any booking made by the Participant.

8.1  A booking deposit payable by the Participant of 0% of the price (including any VAT thereon) shall become due at the time of booking.

8.2 Any additional charges agreed between the Participant and TTW shall be invoiced separately and the Client shall pay any such invoice immediately.

 

8.)  Eligibility

7.1 The Participant agrees that you are of at least 17 years of age or over 

7.2 TTW will not accept competition entries that are (where applicable):

7.2.1 automatically generated by computer;

7.2.2 completed by third parties or in bulk;

7.2.3 illegible, have been altered, reconstructed, forged or tampered with;

7.2.4 indecent, threatening, obscene or inappropriate; or,

7.2.5 incomplete.

7.3 TTW reserve all rights to disqualify The Participant  if his/her conduct (including entry) is contrary to the spirit or intention of the prize of the competition

 

9.) The Prize and Inclusion of flight tickets

9.1 .1“The winner will be only eligible for the Social Travel: North India program of  6 weeks. 

9.1.2 The first five runner-ups would receive 25 % discount + registration fee (worth $30 or $50, depending on the team size) on our Social Travel: North India program.

9.1.3 All the remaining participants would receive a 30% discount and an additional $30 off on our Social Travel: North India program.

9.2. There is no cash alternative for the prize.

9.3 We reserve the right to replace or amend the prize with an alternative prize of equal or higher value.(  TTW might switch the project for something of similar or higher value in case of any unforeseeable circumstances. This will be done after consulting with the winner and only after a mutually agreeable decision is reached..  ) 

9.4 The prize is not negotiable but somehow transferable. Which means The participant cannot exchange the prize for anything else with TTW but however, can transfer his/her prize to any person of his choice. 

9.5 The Competition Rules will detail how the prizes can be claimed. 

9.6.  Information about when the participant/s is interested in joining the program should be given at least 3 months in advance.

9.7. Flight Tickets

9.7.1 The  Flight tickets of  the winner team will be included however  TTW will hold the right to choose the time and type of flight to be booked. 

9.7.2  Flight tickets only upto the cost of $500 will be included

9.7.3 For booking of flight tickets, the winner team has to inform TTW atleat 3 months in advance
 

10. Winner Announcement

10.1 The winner of the competition will be announced on the 4th of october via our Website and our Social Media platforms. However, TTW holds the right to shift this date forward without any notification. 

 Date might be shifted forward. So mention that. In case if draw rounds etc.

10.2 TTW decision or that of the judges nominated by TTW, is final and no correspondence or discussion will be entered into.

10.3 We will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. 

 

 

11. Claiming the prize

11.1 If you are the winner of the trip/discounts, you can claim it three (3) years from the Announcement Date . If you do not claim the prize within the allotted time, your claim will become invalid. 

11.2 Discounts are not available for all trips and services. Please consult TTW to find  where the discounts can be out into use.

11.3 We will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, within 14 days of the Announcement Date, we reserve the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

11.4 We do not accept any responsibility if you are not able to take up the prize.

 

Additional Information 

 

1.1 A binding contract between TTW and the Participant comes into existence as soon as both parties have completed the Booking Confirmation form.

 

1.2  TTW contracts on these conditions only, and acceptance by TTW of any request for the provision of Services from a Participant shall be upon these conditions and shall override any other terms and conditions stipulated or incorporated by the Participant. Variations or representations will only be binding on TTW if confirmed in writing by TTW.

1.3 It is hereby expressly agreed that every servant or agent of TTW (including every independent contractor from time to time employed by TTW) shall take the benefit of every exemption and limitation contained in these Conditions and every exemption from liability, defence and immunity to which TTW is entitled shall also be available and shall protect and extend to every such servant or agent for the purposes of this condition TTW shall be deemed to be acting as agent on behalf of such servants and agents and all such persons shall to this extent be deemed to be parties to the contract of which these Conditions form part.

1. 4 Services:

All descriptions and illustrations contained in TTW literature, price list and advertisements or otherwise communicated to the Client are intended to present merely a general idea of the Services described and shall not form part of the contract.

1.5 TTW Authority:

The Participant and every Guest shall abide by and comply with any request or order made by or on behalf of TTW on the grounds of safety, whether it be the safety of the Client, the Guest or some other person.

​

1.6 The Participant and team mates agrees that the opinion of TTW  or its servants or agents is final in regards to any matters appertaining to safety, and the Participant and every team mate agrees to abide by any such opinion howsoever expressed. If in the opinion of TTW, its servants or agents, the Participant or any teammate  is or may be behaving dangerously or as acting in a manner which would or may in the opinion of TTW its servants or agents lead to a disruption of the Services, the Participant or any teammate shall at the request or order of TTW, its servants or agents, leave the event for the rest of the day contracted for without TTW, its servants or agents having any liability to refund any part of the price paid for the provision of the Services. For the avoidance of doubt, any excessive consumption of alcohol prior to or during the Services shall be treated as behaviour enabling TTW to require the teammate concerned to leave the event.

Law of Contract

The construction, validity and performance of any contract shall be governed in all respects by the laws of the Republic of India.
